भू-अघ्यापति अधिकारी का घेराव
भूमि-अधिग्रहण के खिलाफ सत्याग्रह का पहला चरण समाप्त

22 मई से भूमि अधिग्रहण के खिलाफ गांव-गांव में सत्याग्रह जारी है। शांतिपूर्ण सत्याग्रह के तहत 14 जून 2012 को थराली तहसील पर भू-अघ्यापति अधिकारी ‘‘गांव से कूच’’ किया गया। अगला चरण जल्द ही घोषित किया जायेगा।

भूमि-अधिग्रहण के खिलाफ सत्याग्रह के अंतर्गत 14 तारिख को गंाव-गांव से पंहुचे सैकड़ो की संख्या में लोगो ने ‘‘गांव से कूच‘‘ के तहत तहसील थराली का घेराव किया जहंा भूमि अधिग्रहण प्रक्रिया के लिये भू-अघ्यापति अधिकारी आये थे। डटे रहेंगे नही हटेगें - नही हटेगें - नही हटेगें, बांध कंपनी वापिस जाओं, भू-अघ्यापति अधिकारी वापिस जाओं, केन्द्र सरकार होश में आओं, राज्य सरकार होश में आओं नारों के साथ पिंडरगंगा घाटी के गांवो से मजदूर, किसान, महिलायें, पुजारी, व्यापारी लोग थराली पुल से तहसील पर पहुंचे। उनके बैनर पर लिखा था ‘‘पिंडर को अविरल बहने दो-हमे सुरक्षित रहने दो‘‘। पिंडरगंगा घाटी में भूमि-अधिग्रहण के खिलाफ सत्याग्रह जारी है। जिसके आठवें दिन इस ‘‘गांव से कूच‘‘ का आयोजन किया गया था।
तहसील में पुलिस की भी काफी उपस्थिति थी। जोकि सरकारी जोर जबरदस्ती व उनके गलत कामों का सबूत थी। तहसील प्रांगण में ही दोपहर तक सभी चली। महीपत सिंह कठैत ने कहा कि हमारी धरती को छीनने की कोशिशों को नाकाम किया जायेगा। सरकार विकास के नाम पर हमारी घाटी को बर्बाद नही कर सकती है।
विभिन्न वक्ताओं ने बांध को नकारते हुये गंगा की एकमात्र बिना किसी रुकावट के बह रही पिंडरगंगा को बहते रहने देने के प्रति अपनी प्रतिबद्धता जताई। डा0 जगमोहन रावत, ममता शाह, मुन्नी मिश्रा, नर्मदा देवी, दिनेश मिश्रा, शोभन सिंह खत्री, के.डी. मिश्रा, उमादेवी, बलवंत राम, मदन मिश्रा ने गलत विकास  लोगो पर थोपे जाने का विरोध किया। के. डी. जोशी ने विभिन्न प्रतिनिधियों के हस्ताक्षर युक्त ज्ञापन पढ़ा और उत्तराखंड सरकार के मुख्य सचिव के नाम लिखे गये इस ज्ञापन को मौके पर मौजूद भू-अघ्यापति अधिकारी के प्रतिनिधी बाहर बुलाकर दिया।

ज्ञापन में मुख्य रुप से कहा गया कि            ‘‘भूमि अधिग्रहण कानून 1894 की धारा 17 के अन्तर्गत हमारी भूमि का अधिग्रहण होना गैर वाजिब है। देवसारी जलविद्युत परियोजना {252मेवा} को लोक हित का प्रयोजन बताना गैर कानूनी है। वरन् इस परियोजना से लोक अहित होगा। पतित पावनी पिंडर गंगा जिसकी माता के रूप में पूजा होती है उसे बहती नदी के स्थान पर बहाव रहित तालाबों एवं सुरंगों में बदला जा रहा है। गंगा के पवित्र जल में आक्सीजन की मात्रा कम हो जायेगी। तालाब में बदल जाने के बाद गंगा पवित्र और पूजनीय नहीं रह जायेगी। यह हमारी आस्था पर हमला है।

परियोजना से स्थानीय समाज पर तमाम विपरीत आर्थिक, सामाजिक एवं पर्यावरणीय प्रभाव पड़ेंगे जैसे तापमान में कमी से रोग बढ़ना, भूमि के धसान से मकानों का क्षति ग्रस्त होना, दलदल में मवेशियों का फंसना, जंगल की डूब भूमि से मिलने वाले ईंधन, चरान, चुगान आदि से वंचित होना, महिलाओं को खेती और पशुपालन से वंचित होकर असहाय जीवन जीने के लिये मजबूर होना, बालू एवं मछली व्यवसायियों को बेरोजगार होना इत्यादि।
देवसारी जलविद्युत परियोजना {252मेवा}के कागजातों जैसे पर्यावरण प्रभाव आंकलन रिर्पोट व प्रंबध योजना में भारी कमियां है। अभी परियोजना को कोई पर्यावरण या अन्य स्वीकृतियंा नही मिली है। परियोजनाओं के लिये धारा 17 के अन्र्तगत जाॅंच करने एवं जनता को अपना पक्ष रखने से वंचित किया जाना गैरवाजिब और गैरकानूनी है क्योंकि धारा 17 का उपयोग केवल युद्ध जैसी राष्ट्रीय आपदाओं के लिये किया जा सकता है। सामान्य परियोजनाओं के लिये माननीय उच्चतम न्यायालय के द्वारा इस धारा का उपयोग करना अवैध ठहराया जा चुका है।

वर्तमान भू-अधिग्रहण की कार्यवाही दुराग्रहपूर्ण है और अधिकारियों के द्वारा बिना विवेक को प्रयोग किये की गयी है अतः इसे निरस्त किया जाये।’’

सुभाष पुरोहित सभा के अंत में धन्यवाद ज्ञापन देते हुये कहा की लड़ाई लम्बी है। सरकार समझ ले की संघर्ष गांव-गांव मे चल रहा है।

पिंडर घाटी के लोग हर स्तर पर बांध का विरोध करेंगे। इसी क्रम में भूमि-अधिग्रहण के खिलाफ सत्याग्रह है।

आवश्यक पूर्व जानकारीः-
{पिंडरगंगा घाटी, जिला चमोली, उत्तराख्ंाड में प्रस्तावित देवसारी जलविद्युत परियोजना (252मेवा) विरोधी आंदोलन जारी है। राष्ट्रीय नदी गंगा की एकमात्र स्वतंत्र बहती सहायिका पिडंरगंगा पर बांधो की विभिषिका लादने का विरोध जारी है। ज्ञातव्य है कि इस परियोजना की पर्यावरणीय जनसुनवाई दो बार 13 अक्तूबर, 2009 फिर 22 जुलाई 2010 में रोकी गई। जिसके बाद 20 जनवरी 2011 को बैरिकेट लगाकर पर्यावरणीय जनसुनवाई का नाटक किया गया। 20 जनवरी 2011 को आयोजित जनसुनवाई में सभी प्रभावितों को बोलने का मौका ही नही दिया गया। जिसमें प्रशासन और प्रदूषण नियंत्रण बोर्ड की भूमिका पूरी तरह संदेहास्पद रही है। अपनी आवाज़ को सामने लाने के लिये 3 अप्रैल 2011 में घाटी के हजारों लोगो ने पिंडर के किनारे संगम मैदान में लोक जनसुनवाई में शामिल होकर बांध विरोध में अपनी एकजुटता दिखाई। जिसे यू ट्यूब पर Bandh Katha  टाईप करके देखा जा सकता है। विरोध प्रदर्शन जारी है}

Land Acquisition officer rounded by the people

Satyagraha against Land Acquisition in the Pinder Ganga Valley : end of first phase

{ From 22^nd may there has been satyagraha against the land acquisition in every village. Under peaceful satyagraha, the "Gaon se Kooch" (Rally from the Village) started on 14^th June 2012 from Tharali Tehsil. The next phase will be announced shortly }

On 14^th June, nearly thousand of villagers’ gheraoed the Tharali tehsil under the "Gaon se Kooch" (Rally from the Village) for the satyagrah against the land acquisition where the land question officer had arrived for land acquisition process. Dante rahenge, nai hatenge, nahi hatenge (We will be vigilant, we will not move!), Dam company go away!, Land acquisition officer go away!, Central Govt, wake up!, Central govt, wake up – Labour, farmers, women, Pujari, Businessmen and fisherrmen all from Pinder Ganga Valley have arrived with slogans at Tharali tehsil. The banner they carried the message of – “Pinder ko aviral behne do- hume surakshit rehne do” (Let Pinder flow undammed, let us remain safe!). A satyagrah is going on in the Pinder Ganga valley against land acquisition. On this 8^th day the Gaon se Kooch (Rally from the Village) has been organised

There was considerable presence of police at the tehsil, which is indicative of the state force and wrong doings. The meet took place in the tehsil premises till afternoon. Mahipat singh kaithat said that the efforts to steal our land will be made unsuccessful. The government cannot destroy our valley in the name of development.

All the speakers spoke against the dam and were of the opinion that the Pinder ganga flow unhindered without any obstruction. Dr. Jagmohan Rawat, Mamta Shah, Munni Mishra, Narmada devi, Dinesh Mishra, Umadevi, Balwant Ram, Madam Mishra opposed wrond development beinh imposed on people. K.D Joshi read the resolution signed by the representatives which was written for the Chief Secretary Uttarakhand government and was given to the present land acquisition officer.

The resolution stated that – “Under the Land Acquisition Act, 1894 section 17, acquisition of our land is unauthorized. Claiming the Devsari Hydro electric project (252MW) to be in interest of people is unlawful. In fact people will not benefit from this project. Pinder ganga is revered as a mother and worshipped and this place is being changed to ponds and. The oxygen level in ganga may go down. After getting converted to a pond, the ganga will not remain pure and worship-worthy. It is an attack on our faith.
This project will also have a negative impact on the economic and social lives of the people who live in the region. The impact on the environment is also immense. For example, changes in climate leading to increase in disease, landslides cause damage to housing, cattle getting caught in swampy and marshy land, loss of forest cover and produce due to submersion, loss of sand and fish leading to unemployment. The role of women also changes as they will no longer be involved in agriculture and cattle-rearing. This leaves them helpless and desperate.

The documents of Devsari Hydro electric project (252MW) like the Environmental Impact Assessment Report and the Environmental Management Plan has many shortcomings. The project hasn’t received any clearance as of yet. As per section 17, it unlawful to keep away inspection and the people to put forth their side because section 17 can only be used in war like situations of national emergency. The Honourable Supreme Court has ruled against using section 17 for such regular projects.

The present land acquisition process is faulty and use by the officials without aplying mind. It should therefore be stalled."

Subhash Purohit delivered the thank you speech in the end and said that the struggle is a long one. the government should realise that the struggle is taking place in every village

The people of the Pinder Valley oppose Dam at every level. It is in this regard that the Satyagraha is being launched against the land acquisition.

Background Note:-

Movement is going on against the proposed Devsari Hydro-electric project in the Pinder-Ganga Valley, district Chamoli, Uttarakhand. The Pinderganga is the only free flowing tributary of the National river Ganga. The movement is against the building of huge dams on this tributary. The Public Hearing for Environment was stopped twice on 13^th October 2009 and 22^nd July 2010. On 20^th January 2011, the hearing was a farce with barricades being used against the people. Affected people were not given chance to speak. The role of the administration and Pollution Control Board was completely questionable. In order to bring their voice to the fore, thousands of people in the valley gathered on the banks of the river at Sangam on the 3^rd of April, 2011, for a people’s public hearing. They spoke up against the dam and pledged solidarity to the movement. The clliping of hearing can be viewed on youtube as ‘bandh katha’.
